The EB-5 Program | Benefits1. The EB-5 immigrant visa is the most flexible of the immigrant visas. EB-5 does not restrict the age, business experience, educational background or language skills of an applicant. The applicant needs an investment of $ 1,000,000 or $ 500,000 U.S. dollars ($ 500,000 if through a regional center), from a proven legitimate source of the funds. Legitimate sources include relatives of the applicant, housing and mortgage trading stock gains, corporate profits and so on. Investors, their spouses and unmarried children under 21 years of age may apply simultaneously, which means one investment and the whole family benefits. 2. Quick Examination and Fast Approval. An investor will begin the process by filing a petition with the U.S. Citizenship and Immigration Services ("USCIS"). Upon approval of the petition, normally within six months, the investor and immediate family (spouse plus single children under 21 years of age) may apply for an immigrant visa at a U.S. consulate or apply for an adjustment of status at a regional USCIS office if the investor is already in the United States. The initial resident status is "conditional" for a period of two years. Prior to the two-year period expiring, the conditional resident investor will file a petition with the USCIS to request removal of the condition on permanent residency. If approved, the investor becomes a permanent resident of the United States. Other types of employment and family based green card applications may have many delays and backlogs. 3. No “Residence Requirements” for Investor Immigrants. Successful applicants may remain in their own country, or any other country. As long as the investor holds the permanent residence in the United States, he and his family are not restricted from traveling outside the United States to continue their business. 4. Investors Do Not Need To Participate In Business Management. Investors are not required to participate in the normal company management of the project they invest in and may act as a limited partner. 5. Five years after holding a green card, investors may apply to become a U.S. citizen. |
