1.    Where can I find relevant EB-5 laws and regulations?
More information can be found on the United States Citizenship and Immigration Service (USCIS) website (www.uscis.gov). USCIS is the government agency responsible for the implementation, administration of immigration and naturalization laws, rules and regulations, functions and policies.  You can also find relevant information at the US Department of State’s Visa Office: www.travel.state.gov.


2.    Are EB-5 visas available to anyone outside of the U.S.?
Yes.  The EB-5 Visa Program is available to anyone from any country.  However, potential investors from countries that do not have reliable tax laws and/or require reliable financial documentation will find it much more difficult to prove the source of funds which is a key element to a successful approval of an EB-5 application.


3    Who can invest through the EB-5 program?
Anyone meeting the qualifications to invest is eligible to invest through the EB-5 program.  The EB-5 visa gives you the flexibility to work, go to school or retire in the United States; to do what you want.


4    If I want to invest in an EB-5 project in Oregon, do I have to live in Oregon?
No.  The EB-5 Visa Program allows you to maintain your Permanent Residency by living anywhere in the U.S.  There is no requirement that you live where you make your EB-5 investment.


5.    What issues have been problematic in EB-5 cases?
The most common problem area has been insufficient documentation of the source of funds. Many people try to disclose the least possible information only to have the file returned with a request for further information.  It is advisable to consult a U.S. immigration lawyer to provide sufficient information for success.
